– When do you need an Apostille Certificate? –

Apostille Certificates are issued in selected cases, where documents are used internationally. The country where the document originates as well as the country where the document will be used, need to be parties to The Hague Convention, before the Apostille certificate can be added.

WHAT IS THE PROCESS TO OBTAIN AN APOSTILLE?

The notarial practice differs, depending on the nature of the document.

Some of the steps may include:

  • The notary will inspect, verify and authenticate the South African documents
  • The notary then obtains authentication by the Registrar of the High Court
  • The Registrar’s signature must then be authenticated by the Department of International Relations and Cooperation (DIRCO)
  • The document is then taken to the relevant foreign embassy in South Africa of the country where the document will be used
  • The foreign embassy then sends it on to the relevant authority in the foreign country that requires the document or the foreign embassy provides further validation and authentication of the document

Every notarial document may have a different process, depending on the circumstances and nature of the document.

WHAT IS THE PROCESS FOR OBTAINING AN APOSTILLE CERTIFICATE?

The notarial practice differs, depending on the nature of the document.

Different documents will follow a different process and the timelines for obtaining an Apostille certificate can be extensive. The consent of different role players such as the High Court or government departments need to be obtained in certain circumstances. Obtaining an Apostille certificate can therefore take either a few days or it can take months, depending on the nature of the document that is to receive the Apostille certificate.

Documents issued by the Department of Trade and Industry, the Companies and Intellectual Property Commission (CIPC), the Department of Home Affairs, Department of Higher Education and Training, Department of Basic Education, Police Clearance Certificates issued by the South African Police Services, the Chamber of Commerce and Industry the Department of Transport and the Health Professionals Council must be authenticated by those respective departments, before the Apostille certificate is added by the Department of International Relations and Cooperation. Thereafter those documents can be presented and used internationally.
